GENERAL CONDITIONS OF SALE AND USE OF THE SITE

The general conditions of use and sale detailed below have for object to govern the whole of the contractual relations between the Company Roller'n co, with the capital of 1 000 € - RCS AVIGNON N° Siret 752 538 546 00033 hereafter called " Roller'n co ", and the Customers wishing to carry out purchases and sales on the Internet site of www.rollernco.com.

These conditions do not apply to purchases made in other outlets.

These general conditions of use and sale are systematically proposed to the buyer at the time of validation of the order. Thus, the fact of placing an order on www.rollernco.com implies the whole adhesion and without reserve of the customer, and Roller'n co, with these general conditions of use and sale.

Roller'n co can modify at any time all or part of the provisions of these general conditions of use and sale.

General conditions of use of the site

1. REGISTRATION

To be able to buy, the customer must fill in a registration form and complete all the required information. The information provided, in particular concerning identity, residence or delivery address, billing and payment details, must be true, accurate, valid, verifiable, up-to-date and sincere. The customer must spontaneously update the information. If one or more of these data are false, erroneous, inaccurate, outdated or incomplete, Roller'n co will suspend or close the customer account without notice.

2. PERSONAL USE

Is exclusively considered as Customer the person whose information has been provided on the registration form. The customer agrees to personally use the Services and not to allow any third party to substitute him in this use, in his place or on his behalf, except to bear full responsibility. The customer is responsible for maintaining the confidentiality of the passwords and identifiers used to access the site's services. In case of breach of obligations of personal use, Roller'n co will suspend or close the customer's account without notice, suspend the services provided, without excluding the possibility of seeking compensation for damages suffered. The customer who has knowledge of the use of his account without his knowledge must immediately contact Roller'n co at the email address contact@rollernco.com. He recognizes Roller'n co the right to take all appropriate measures to put an end to this situation.

3. PAYMENT AND SECURITY OF BANKING DATA

The amount due by the customer is the amount indicated on the order confirmation sent by e-mail by Roller'n co to the customer.

The payment will be carried out, except unavailability of the waiter, immediately on Internet by Bank Card (Blue, Visa, Eurocard/Mastercard) or Paypal being specified that only the Bank Cards delivered by a French financial establishment will be admitted.

Paypal is committed to protecting your purchases against fraud and data encryption. 

Indeed, if you do not receive an eligible purchase or if it does not correspond to the seller's description, they are committed to refunding you. In addition, they monitor every transaction 24/7 to prevent fraud, email phishing and identity theft. Finally, every transaction is secured by their advanced encryption technology. 

In any case, Roller'n co reserves the right to refuse any order or any delivery in case of existing dispute with the customer, total or partial non-payment of a previous order by the customer, refusal to authorize payment by credit card from banking organizations, non-payment or partial payment, use of a credit card not issued by a French financial institution. Roller'n co will not be able to be committed in this respect.

No personal banking data of the customer is kept or communicated to third parties. At the time of confirming his order the customer is directed towards the site of protected payment of the banking provider.

     4. PROHIBITED BEHAVIORS

The following are strictly forbidden, under penalty of legal action

a) any behavior that may interrupt, suspend, slow down or prevent the continuity of the Services,

b) any intrusion or attempted intrusion into the Site's systems,

c) any detour of the system resources of the Site,

d) any actions of a nature to impose a disproportionate load on the infrastructures of the latter,

e) any breach of security and authentication measures and

f) any acts likely to damage the rights and financial, commercial and moral interests of Roller'n co or Users of the Services. In case of breach of any of the provisions of this paragraph or more generally, violations of laws and regulations of any country, Roller'n co reserves the right to suspend or terminate the account of the customer at any time without notice. The aforementioned behaviors will be considered as contrary to the Terms of Services.

5. COMPLAINTS - INFORMATION - NOTIFICATIONS

Any complaint, request for additional information or notification provided for in the Terms of Service must be sent to the following e-mail address: contact@rollernco.com and must include the customer's identification (last name, first name, contact details), as well as the reasons for the complaint if applicable and the reference of the order concerned. Damage, theft and loss must be immediately reported to this email address.

6. INTELLECTUAL PROPERTY

The systems, software, structures, infrastructure, databases and content (text, images, visuals, music, logos, trademarks, etc ...) implemented by Roller'n co are protected by all intellectual property rights. All disassemblies, decompilations, decryptions, extractions, reuses, copies and more generally, all acts of reproduction, representation, distribution and use of any of its elements, in whole or in part, without the authorization of Roller'n co are strictly prohibited and will be prosecuted. The photographs illustrating the goods on the Site do not have contractual value because of the modifications likely to be carried out by the suppliers and which can exist after the installation of the data of the site.

7. RESPONSIBILITY

Roller'n co carries out regular checks to verify the functioning and accessibility of the Site and the functioning of the Services. As such, Roller'n co is likely to interrupt momentarily the access to the Site for maintenance reasons. Similarly, Roller'n co can not be held responsible for difficulties or temporary inability to access the Site due to circumstances outside of its control, force majeure, or due to disruptions in the telecommunications network. The customer is informed of the complexity of global networks and the influx, at certain times, of Internet users. Roller'n co will compensate the customer for any direct damage resulting from proven failures on its part in the execution of the obligations it assumes under the terms of the present. Roller'n co will not be liable to the customer or to third parties

a) in the case where the damage claimed by the customer would result from a total or partial non-performance of the contract, or a poor performance of obligations incumbent on him;

b) in the case where the damage invoked by the customer would result from any use which would not be in conformity with a normal use and in conformity with their function;

c) in all cases where the damage claimed by the customer would result from any fault on its part, including tort. In any case, the responsibility of Roller'n co, because of any damage resulting from the non-performance or poor performance of its services can not exceed, all damages, the total price of orders placed by the customer in the 3 (three) months preceding the damage claimed by the customer.

8. PERSONAL DATA

Roller'n co proceeds to the processing of personal data necessary for the opening and the follow-up of the Users' accounts, as well as to the taking into account of requests of customer wishing to make known the Site to their knowledge. This information is kept confidential and treated in the respect of the private life of the customer. The information requested is intended for Roller'n co and if necessary, only for what concerns them, to its providers. In accordance with the Data-processing law and freedoms, the customer has a right of access, of correction and suppression for legitimate reasons of the data concerning it. Roller'n co implements an internal treatment relating to the prevention of the risks to which the customer is likely to be registered in the event of non compliance with the Conditions of Services. Such registration will exclude any possibility of further use of the Services, except in the event of established regularization. The information is only accessible to the personnel in charge of the commercial and administrative services, as well as to the service providers contractually linked to the execution of the orders. Unless the customer objects, from the registration to the site or from the opening of a user account, Roller'n co is likely to send him information and prospecting messages likely to interest him. The customer may object at any time by sending an email to the address specified below with the subject "Stop Prospecting". To exercise their rights or for any request, Users must send an e-mail to contact@rollernco.com

9. APPLICABLE LAW AND JURISDICTION

The Terms of Service are governed by French law. In the event of a dispute over their interpretation and/or execution, the only competent court will be the Commercial Court of Aix en Provence.

10. MODIFICATIONS

Roller'n co may, at its sole discretion, modify at any time the Terms of Use and Sale, in whole or in part. The changes are effective from their publication on the Site. The use of the Site by the customer after the implementation of these changes implies that he recognizes and accepts the new Terms of Use and Sales.

 

 

Terms and conditions of sale

The site rollernco.com has for activity the online sale of accessories and materials of sliding sports; inline skating, roller quad (rollerskates), aggressive roller, skateboard, longboard, surfskate, cruisers, freestyle scooter, BMX, ice hockey, roller field hockey and ice skate (or figure skate) for individuals.

1. SALES PROCESS

1.1. THE ORDER

Viewing the basket and validation of the order:

The buyer checks the details of his order (references, quantities) and its total price.

He has the possibility to modify the composition of his order (addition or deletion of articles, quantity, color, size etc.) The update of the basket and the price will be done automatically. The customer can then confirm the order.

The sale will be considered concluded on the date on which the buyer will receive by email the confirmation of his order where the status of the order must be in payment accepted.

And after validation of the transaction by our banking service and subject to the controls provided for in Article 3 of the conditions of use of the site.

My Account:

If the buyer has already placed an order on the site, he can directly access his account by entering his login (email address) and password.

If it is his first order, the buyer has several possibilities.

- Either he/she must create an account on which he/she will indicate all the requested information necessary for the good routing of his/her order.

- Or he can place his order as a "guest" if he does not want to create an account.

If this is the buyer's first order, he/she must create an account on which he/she will indicate all the requested information necessary for the proper delivery of his/her order.

Please note:

The information and details provided by the buyer during the order are binding.

In case of error(s) of seizure or incomplete mention in the wording of the coordinates of the recipient, Roller'n co could not be held responsible for the consequences that it would generate and the impossibility of ensuring the delivery.

This is valid in case of delay as well as error of delivery. In this case, all costs incurred by Roller'n co will be fully charged to the buyer.

Acceptance of the General Conditions of Sale and use of the site:

After having checked the details of his order and filled in the various details requested, the buyer must, to continue, acknowledge having read these general conditions of sale and use. The validation of the order therefore entails the acceptance without any reservation of these general conditions of sale and use.

Coordinates:

The buyer must validate his billing address and his delivery address.

Methods of delivery:

The buyer must now select the delivery method. He is then clearly informed of the price of each of the proposed modes of delivery. For the details of the modes and rates of delivery, it is advisable to refer to the provisions of article 4 of the present.

Methods of payment:

Last step before the final validation of the order, the buyer must choose his method of payment: by credit card in secure transaction, according to the prescriptions of the article 6 or by check if the company Roller'n co accepted this mode of payment.

A complete summary of the order is then visible. Remain to click on the button 'Validate your order'.

Summary sheet:

Once the payment is validated, the buyer is redirected to a page of our site presenting a summary of his order detailing: the items purchased, the quantities, the prices, the delivery method chosen, the cost of delivery, the total amount and the payment method. He can then print this summary or return to the store.

An email confirming the order with the order number will be sent as soon as possible. In the case of an online payment by credit card, a second payment confirmation email will also be sent.

The contract is concluded:

For payments by credit card, after collection and verification of the details provided by the customer and subject to request for additional information, as provided in Articles 3 and 4 of the general conditions of the site.

For payments by check after receipt and cashing of it.

All the data provided and the confirmation of the buyer will be worth proof of the transaction. The confirmation of the buyer will be worth signature and acceptance of the purchases carried out.

We advise you to keep all electronic and paper documents related to the order until the end of its execution. The buyer will receive an email notifying him of the shipment of his order if it is a "controlled" order. However, Roller'n co can not be held responsible for the non-performance of the order in case of force majeure.

Roller'n co reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order.

2. THE PRICE

All our prices are quoted in euros and TTC (all taxes included) excluding shipping costs (unless explicitly stated).

The site Roller'n co can be required to change its prices at any time but undertakes to apply the rates in force indicated on the product sheet of the site a the time of registration of the order subject to availability on that date and its payment.

3. AVAILABILITY OF PRODUCTS

Any order will be honored within the limits of available stocks.

In case of stock shortage, we commit ourselves to inform you by e-mail within seven (7) days from the date of your order. We will tell you how soon the product(s) can be delivered. You can then, if you wish, cancel the order. Without response from the buyer within 7 days (seven days) from the alert email indicating the delivery time. Roller'n co will consider that the buyer maintains his order and accepts the new deadline.

4. THE MODALITIES OF DELIVERIES

1. Chronopost :

→ (Deliveries are offered in relay point from 70 euros of purchases for Metropolitan France except field hockey sticks)
- Home before 13h (16.95 euros)

2. Colissimo

- Point relais 
- Home delivery against signature 
→ (Delivery is free for purchases of 70 euros or more in Metropolitan France, excluding field hockey sticks, for both Colissimo methods)

- Click and collect (free)

- DPD home (8.90 euros)

Roller'n co will make every effort to ensure that your order is delivered within the time limit. Nevertheless, we can not be held responsible for the consequences due to a delay in delivery or a loss of a package caused by a third party or yourself or because of an unforeseeable and insurmountable cause constituting a case of force majeure.

In case of stock shortage and, consequently, extension of the delivery time, Roller'n co undertakes to warn you within a maximum period of seven (7) days from the date of your order. In the same way, in the case where one of the ordered articles would be momentarily unavailable, the whole order would be delivered once this last article available. In all cases, an e-mail will inform you of the situation and you will then be able to choose a pure and simple cancellation of the order of this article that we will refund you within thirty (30) days.

In case of non-receipt of a package within the indicated time, an investigation will be conducted with the carrier. Such an investigation may take several days, during which time no refund or return can be made.

Finally, Roller'n Co will not be able to proceed to the reimbursement of one or several orders in the case where the computerized tracking system of our carrier confirms that the package(s) have been delivered; the information contained in the information system of our carrier being authentic.

The rates (which vary according to the weight and the zones) change often, the rate making faith and that present on the purchase order of the purchaser at the time of his order taking.

In case of absence:

If the Buyer is absent at the time of delivery, he/she undertakes to collect the item(s) as soon as possible. In the event that the Buyer fails to pick up the item(s), it (or they) is (are) returned to Roller'n co, the Buyer agrees that the shipping costs he has paid will not be refunded. The buyer must also pay the amount of the return if he wants it. Otherwise Roller'n co will not refund the goods returned in this order.

In all cases, the Buyer will notify Roller'n co of the non-receipt of his purchase as soon as possible so that it takes all the measures either to make a re-delivery or to return the package to Roller'n co. If the Buyer does not notify within 72 (seventy-two) hours, the package is deemed delivered.

Incidents of delivery

On the day of delivery, we strongly recommend that you carefully check the packages and verify the contents in the presence of the deliveryman.

Any complaint concerning the number, contents and condition of the packages must be notified clearly and precisely to the carrier himself. You must also inform us within 24 hours of receipt of the package, by sending an email to Customer Service, contact@rollernco.com specifying your contact information, your invoice number, the references of the product(s) listed on the invoice and specifying the reasons for your claim.

5. CONFORMITY OF THE GOODS

We pay the greatest attention to the quality of our products. All orders are checked at the time of shipment.

However, it may happen that the goods are damaged during transport (breakage, shock, deformation...) or that they do not conform to the specifications indicated on your order form (product error, color...), this is why:

We strongly recommend that you open the package(s) in the presence of the delivery person and make sure that the goods are in good condition. If necessary, you must make a reservation on the delivery slip.

In the absence of precise and detailed reservations on the delivery slip, the goods will be considered as delivered in conformity.

6. THE PAYMENT

The payment methods accepted by the site Roller'n co are the following:

- Credit card (Carte Bleue, Visa, Mastercard)

- Bank transfer

- Paypal (with the possibility of a payment in 4x without possible expenses)

The payment is made online, when the order is taken, in SSL (Secure Socket Layer) and 3DSécure secure transaction thanks to the E transactions payment system certified by the Crédit Agricole for the payments in bank card..

When you enter your bank details, you are directly connected to the secure payment server (in https mode). All data entered is immediately encrypted and cannot be intercepted or modified. Once the payment is done and confirmed, you will be redirected to our site.

At no time the Roller'n co site has access to your card number, nor does it keep it. Payments by credit card are subject to automated processing and are remitted to the bank once your order is in preparation.

An invoice, with details of the VAT, will be sent to you by mail and available in your account. Keep it: it will serve as proof of payment and as a guarantee voucher if some of your items are subject to guarantee.

7. RIGHT OF WITHDRAWAL

In accordance with article L121-20 of the French Consumer Code, you have a period of fourteen (14) days to return to us, at your expense, a product that does not satisfy you.

This period of retractation is valid only for the mail order and for new articles. In case of return, Roller'n co will offer you a refund, an exchange or a credit. In case of return of only a part of the order, the shipping costs will not be refunded.

Procedure:

Conditions: All products must be returned in their original packaging and condition, without having been used, rolled or damaged. If these are not respected, we reserve the right to refuse your return. Unless it is an error on our part, return shipping costs are at the customer's expense. 

How to do it: 

1. Go to rollernco.com → my account → order history and details → details of the order in question.
2. Select the items you wish to return, indicate the reason for your return, and the type of refund you want. Then click on return a product.
3. Once your return is accepted you will receive a return slip by email with all the information to return your product(s). You must send back your product only once the state of the package is "awaiting package" it means that we have confirmed your request.

To know the progress of the return of the product you can look at the status of the product in the section "product return".

Interpretation of the states :

1. Return status: waiting for confirmation from us
2. Waiting for package: we have accepted your request and now you can send us your package 
3. Package received : we have received your package in our premises
4. Return refused: We do not accept the return of a new item, if you want to keep it despite our refusal to change your product you must pay the shipping costs for the return
5. Finished: The link between you and us is finished. We sent your package and you received it. 

If the state is modified the customer will receive by mail all the information concerning the nature of the modification and the necessary elements.

8. RESERVATION OF OWNERSHIP

It is agreed that the goods delivered and invoiced to the customer remain the property of Roller'n co until complete payment of their price, in application of the law n°80-335 of May 12, 1980 and articles 115 paragraph 2 and 122 of the law n°85-98 of January 25, 1985.

In case of non-payment, Roller'n co can claim the goods.

In any case, the provisions relating to the reserve of property do not prevent, from the delivery, the transfer to the buyer of the risks of loss or deterioration.

9. EXEMPTION FROM LIABILITY

The products offered are in conformity with the French legislation in force.

The photographs and descriptions of the articles are present on the site as an indication, in order to help the purchaser to make his choice. They have no contractual value.

Roller'n co cannot be considered as responsible for any breach of its obligations under these general conditions of sale due to facts beyond its control and / or resulting from a case of force majeure recognized as such by the French Courts and Tribunals.

10. USE OF PERSONAL DATA

In accordance with the French law n° 78-17 of January 6, 1978 relating to data processing, files and freedoms, you have a right of access and of correction to the personal data concerning you. To exercise this right, you just need to make a request, specifying your name, first name and address, by email to contact@rollernco.com.

The data you will have communicated on the site are intended only for Roller'n co and its service providers for the proper processing of your requests and orders.

If you have placed an order on Roller'n co or if you have subscribed to our electronic newsletter, we can send you our commercial offers and information on our products by e-mail. 11. INTELLECTUAL PROPERTY

All texts, illustrations and photographs presented on the Rollernco site are and remain the exclusive intellectual property of Roller'n co. Any reproduction, use or redistribution, even partial, is strictly prohibited.

12. LAW AND COMPETENT COURT

The present general conditions of sale are governed by the French law. In the absence of amicable agreement between the two parts, the court of Aix en Provence will be only qualified.
